The information contained within this document relates to the Ukiyo World online store (the “Site”), trading under Ukiyo World PTY LTD. This Site is an ecommerce website.

By using this site and/or purchasing a product from us, you indicate that you have read and understood these Terms and Conditions and agree to abide by them at all times. 

These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

Intellectual Property

All content published and made available on our Site is the property of Ukiyo World and the Site’s creator. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.


Accounts

When you create an account on our Site, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.


Sale of Goods

These Terms and Conditions apply to all the goods that are displayed on our Site.

The following goods are available on our Site:

  • Handcrafted, scented candles; and

  • Gift Cards.

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We also reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time and will not be liable to you for any third-party modification, price change or discontinuation of the item.

Subscriptions 

Your subscription automatically renews and you will be automatically billed until we receive notification that you want to cancel the subscription.

To cancel your subscription, please follow these steps: By purchasing a Monthly Subscription, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. Your subscription will be automatically extended for successive monthly periods, at the then-current subscription rate. To cancel your Monthly Subscription, log in to your account and follow the cancellation procedures or email us at ukiyoworld.store and we will help you. If you cancel, you may use your subscription until the end of your then-current subscription term. Ukiyo World may submit periodic charges (e.g., monthly) without further authorisation from you until you provide prior notice that you have terminated this authorisation or wish to change your payment method. Such notice will not affect charges submitted before Ukiyo World could reasonably act.

Payments 

We accept the following payment methods on our Site:

- Credit Card;

- PayPal;

- Debit; and

- Direct Debit.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument. 

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.


Shipping and Delivery 

When you purchase goods from our Site, the goods will be delivered through one of the following methods:


Australia

We aim to process and ship all online orders within 1 to 4 business days following the day your order was placed. Please note: During peak periods (Sales, Promotions, Public Holidays), dispatch times may be longer.

*Our delivery times are based on Metro areas, please allow an additional 1-2 days for regional deliveries and 3-4 days for remote areas.


International

We aim to process and ship all online orders within 1 to 4 business days following the day your order was placed.

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and public holidays.

You may be required to pay delivery charges in addition to the price for the goods you purchase.

If you purchase goods from us for delivery to a destination outside Australia your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information. 

Pricing

All Ukiyo World item prices are displayed including GST and exclusive of delivery charges. The total cost of your order is the price of the Products ordered plus GST and delivery charges as displayed during the checkout process.

Product Availability

All Ukiyo World Products are subject to availability. We aim to ensure stock levels reflected on the Ukiyo World online store are in line with what is available for you to purchase, however, there may be times when discrepancies might occur. In the event we are unable to fulfil your order, we will notify you and offer you one of two options:

  1. Provide an alternative option

  2. Choose to wait for the candle to be made (Ukiyo World candles are made in small batches to retain the utmost quality, and reduce our impact on the environment)

Ukiyo World scented candles are hand-poured using a blend of 100% natural soy wax derived from vegetable soybeans. While most paraffin wax candles will come with a silky smooth top, you may notice slight variations in our soy wax candles throughout the year. This doesn’t mean there is anything wrong with your candle, it’s just part of the natural cooling process, and we’d rather have slight imperfections than use a non-natural alternative. We take pride in the quality of our products and do regular tests to ensure we are offering the utmost quality to our customers. 

Products may also vary slightly from their pictures displayed online or on our social media channel. The images of our products used on our website and Instagram account are for illustrative purposes. While we aim to display the correct colours, we can’t ensure that each device displays the colours h we have made every effort to display the colours accurately, we cannot guarantee that a device will display the colours precisely. Therefore, the product you receive could vary slightly from the images you displayed. 

Refunds 

Refunds for Goods 

Refund requests must be made within 7 days after receipt of your goods.

We accept refund requests for goods sold on our Site for any of the following reasons:

- Item is broken; or

- Incorrect scent is delivered


Returns 

Returns can be made by mail. To return a good by mail, please forward any claims for damaged or incorrect items to Ukiyo World customer service within 7 days of receiving the product(s). Any claims lodged after this period will not be accepted. In order to return or exchange a product, you must provide a valid proof of purchase (including receipt, e-receipt, or gift receipt).

Returns are only applicable if the item was purchased from our online store, returned unused, housed in original packaging and with original labels. If items are returned in a poor condition where we can’t resell them, we may not accept your return. If your purchase was made through a partnered retailer or online store, then any returns or exchange will need to be made through the relevant retailer and not returned to Ukiyo World. We will not accept returns based on change of mind. Returns will only be accepted if the product is damaged or the incorrect item was shipped.

Exchanges are subject to product availability and will be actioned only once the product has been received and processed successfully. The customer is responsible for the shipping costs for the return and re-delivery of an exchange.

Ukiyo World Digital Gift Cards

A Ukiyo World Digital Gift Card entitles the owner to purchase products up to the nominated value at the Ukiyo World online store in Australian dollars. It cannot be reloaded, exchanged or redeemed for cash, or transferred to another digital gift card or owner. Ukiyo World Digital Gift Cards are valid for 12 months from the date of purchase (not applicable in the United States of America and Canada). After the expiry date, the card will have a nil balance. Please note, Ukiyo World Digital Gift Cards are currently only available to purchase within Australia.

Consumer Protection Law 

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.


Force Majeure.

If Ukiyo World is delayed or hindered in or prevented from performing any of its obligations under any Order by reason of any event or circumstance beyond its reasonable control, Ukiyo World will have no liability to you in respect of such non-performance and the time for performing the same will be extended until the event or circumstance has ceased.

Limitation of Liability 

Ukiyo World and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity 

Except where prohibited by law, by using this Site you indemnify and hold harmless Ukiyo World and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law 

These Terms and Conditions are governed by the laws of the State of Victoria.

Severability 

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes 

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
